According to the FDA news release:

"Today, the U.S. Food and Drug Administration is announcing proposed product standards to prohibit menthol as a characterizing flavor in cigarettes and prohibit all characterizing flavors (other than tobacco) in  cigars. These actions have the potential to significantly reduce disease and death from combusted tobacco product use, the leading cause of preventable death in the U.S., by reducing youth experimentation and addiction, and increasing the number of smokers that quit."

Vape Regulation Is Coming, and It Just Might Kill the Industry

- - - original post follows below - - -

FDA Seeks to Regulate e-Cigs, All Other Tobacco Products - Medscape:

"The FDA initially announced its intention to assert jurisdiction over unregulated tobacco products back in 2010. In April 2011, the FDA announced its plans to include e-cigarettes among these products.

The new proposal would extend the FDA's basic authority to all other tobacco products beyond what it already regulates on the basis of the 2009 Family Smoking Prevention and Tobacco Control Act.

Currently, unregulated tobacco products include not only e-cigarettes but large and small cigars, as well as hookah and pipe tobacco, smokeless tobacco, and other tobacco products."

FDA's New Tobacco Scheme, and its Legislative Underpinnings, May Go Up in Smoke - Forbes:

"Several years ago, the federal government entered into a Faustian bargain with the tobacco industry — and the cigarette makers with the government. It was legislation borne of mutual antipathy.

Under the scheme, Washington brought the tobacco industry under the thumb of federal regulation. FDA now oversees everything from the way cigarettes are marketed, to the manner in which they are made. In exchange, the tobacco industry was promised a regulatory track out of their current (declining) business model.

FDA was to create a path to enable cigarette makers to transition away from smoked tobacco and win government approval of consumable products that used tobacco but presumably harbored less, and perhaps even none of the health risks posed by smoking. "

World No Tobacco Day is May 31st

If you're a smoker, consider trying to stop smoking on World No Tobacco Day.

On the 31st of May each year, WHO celebrates World No Tobacco Day, highlighting the health risks associated with tobacco use and advocating for effective policies to reduce consumption. Tobacco use is the second cause of death globally (after hypertension) and is currently responsible for killing one in 10 adults worldwide.

The theme of World No Tobacco Day 2010 is "Gender and Tobacco" with an emphasis on marketing to women. The campaign focuses on the damaging effects of tobacco marketing towards women and girls.

The World Health Organization (WHO) urges governments and the public:

  1. to demand a ban on all forms of tobacco advertising, promotion and sponsorship
  2. to support implementation and strong enforcement of legislation to provide 100% protection from tobacco smoke in all public and work places, and
  3. to take global action to advocate for women's freedom from tobacco.

Tobacco Products - Big Pharma Takes On Big Tobacco

Dunhill Early Morning Pipe Tobacco, 1990's MurrayImage via Wikipedia
This is an interesting battle that's emerging, according to Timothy Carney in his article, Big Pharma rumbles with Big Tobacco on products.

The viewpoint provides a good grounding of the tobacco product landscape, and the emerging industry heavyweights positioning to do battle for government influence and ultimately consumer dollars.

Who's going to win?

FDA Restricts Cigarette and Tobacco Sales and Distribution

I don't smoke, so I'm happy to see this action coming from the FDA, FDA Regulations Restricting the Sale and Distribution of Cigarettes and Smokeless Tobacco. The new rule becomes effective June 22, 2010, and has the force and effect of law.

Here are the highlights:

New Requirements Relating to Sale and Distribution

  • Prohibits the sale of cigarette packages with fewer than 20 cigarettes.
  • Prohibits the sale of cigarettes and smokeless tobacco in vending machines, self-service displays, or other impersonal modes of sales, except in very limited situations.
  • Prohibits free samples of cigarettes and limits distribution of smokeless tobacco products.
New Requirements Relating to Marketing (Labeling, Advertising, and Promotion)
  • Prohibits tobacco brand name sponsorship of any athletic, musical, or other social or cultural event, or any team or entry in those events.
  • Prohibits gifts or other items in exchange for buying cigarettes or smokeless tobacco products.
  • Requires that audio ads use only words with no music or sound effects.

Electronic Cigarettes - Update - Ruling Stops FDA From Blocking Importation

A federal judge says the FDA (Food and Drug Administration) overstepped its authority in efforts to regulate electronic cigarettes, reports this Washington Post article, FDA can't block importing of 'electronic cigarettes'.

The FDA's position:
FDA says they've found cancer-causing ingredients in the products, despite manufacturers’ claims that they are safer than tobacco cigarettes.

The judge's position:
Electronic cigarettes are “the functional equivalent of traditional cigarettes."

Bottomline:
U.S. District Judge Richard J. Leon determined that electronic cigarettes are tobacco products and are not subject to restrictions.

NPR On FDA Tobacco Oversight (audio)

This audio news story, Talking Tobacco Companies Into FDA Oversight, fresh from NPR:

The Food and Drug Administration (FDA) will have regulatory authority over the $89 billion tobacco industry as soon as President Obama puts his signature to a bill passed by Congress. The change took decades to happen — the industry fought hard to keep the FDA out — but finally succumbed to changing social norms and the guidance from one in its own ranks. Guest host Alison Stewart speaks with Steve Parrish, a former Altria executive and who pushed the company to support FDA regulation of the tobacco industry, and Dr. David Kessler, who was head of the FDA in the mid-1990s.
As a non-smoker, I'm thrilled to see this new day of FDA oversight. As a country we should be paying more attention to improving population health.
