FDA'S Response To Cargo Thefts

The FDA wants to make sure that drugmakers do more than bolster internal operations. In a new standard operating procedure, the agency wants the pharmaceutical industry to know that there are various obligations when a theft occurs and this includes alerting regulators and the public.

FDA STAFF MANUAL GUIDES, VOLUME IV - AGENCY PROGRAM DIRECTIVESGENERAL OR MULTIDISCIPLINEFDA'S RESPONSE TO CARGO THEFTS - Effective Date: 03/23/2012

The purpose of this Standard Operating Procedure (SOP) is to provide a general procedure for determining FDA’s regulatory response when a cargo theft involving an FDA-regulated product has occurred. When followed in conjunction with the established procedures for product removal from the market, public notice, and handling medical product shortages, if applicable, the procedures described in this document will ensure that FDA’s regulatory response to cargo thefts is consistent and effective.

Big Pharma Drug Theft Problem

An illustration of a company's supply chainImage via Wikipedia
Uh-oh.

Katherine Eban reports in Fortune Magazine, Drug theft goes big - Organized gangs are stealing prescription medicine in increasingly audacious heists - That's a problem for Big Pharma and for patients, who can unknowingly buy stolen -- and sometimes dangerous -- medications.

In a nutshell, drug warehouses and supply chains appear to be vulnerable. In some cases, the vulnerabilities allow for stolen, unapproved, illegally imported, expired, and counterfeit drugs to get into the marketplace.

FDA Wants Companies To Prevent Cargo Theft

The FDA is committed to protecting consumers from the threat of stolen, counterfeit, and diverted FDA-regulated products such as prescription or over-the-counter medicines, medical devices, or infant formula.

The U.S. Food and Drug Administration sent a letter (FDA urges industry to prevent cargo thefts - UPI.com),  to companies and a wide range of other key stakeholders detailing the agency’s concern over cargo and warehouse thefts of FDA-regulated products.  In its letter, the FDA seeks to:
  1. raise awareness among industry about each firm’s responsibility to review and strengthen their security practices
  2. inform industry of the actions the FDA will take when the agency becomes aware of a large-scale theft, and outlines steps that firms should take
  3. emphasize the importance of notifying and informing members of the supply chain and the public after thefts occur.
The FDA believes every company should have a clear plan developed on how to respond to these incidents, since swift action is essential. The agency believes prevention of cargo theft is critical. To help achieve that goal, the FDA will continue to work closely with manufacturers and wholesalers to find ways to better secure the nation’s supply chain, which protects the public health.

Additional FDA Resources:
The FDA Cargo Thefts Webpage - FDA created this webpage to provide timely notice to the public about cargo thefts involving FDA-regulated products that have been stolen either from warehouses or tractor-trailers.

FDA Regulated Businesses - Will you be compliant with the new FTC rule?

If you're in the FDA regulated industries, you might want to pay attention to the FTC's new rule according to this Casetext post, August 1, 2009 - FTC’s New Identity Theft Rule Probably Requires You To Comply. In a nutshell, Koustas & Fleder say:
Given the apparent reluctance of the FTC to create exemptions from this regulation, most companies regulated by FDA must determine if the Rule applies to them. If the answer is yes, there is an August 1, 2009 deadline fast approaching to develop and implement a compliance plan. Failure to comply may subject the entity to administrative enforcement action by FTC as well as civil liability to consumers.

---  the original post follows below  ---

And you thought you only had to worry about your credit cards and bank accounts. Looks like crooks are also trying to move into the medical identity theft arena. According to Brenda Evans Hart (the federal Health Insurance Portability and Accountability Act privacy officer at Baylor College of Medicine), "I think now it's gone so far as to be part of organized crime for fraud regarding Medicare, Medicaid and regular commercial insurance." Additionally, Hart said. "And of course, that comes out of the taxpayers' pockets as well." Hart is cited in this Houston Chronicle article, "Medical records emerge as latest trend in I.D. theft." The article includes the following tips . . .

Safety Tips From The World Privacy Forum:
  1. Review statements from your health insurer. Specifically, look for charges you didn't make.
  2. Ask your health care provider or insurer for an accounting or history of disclosures.
  3. Watch your credit report for any collection notices for unpaid medical bills.
